CCAGW Urges Oklahoma Senators to Sustain Governor Stitt's Veto of HB 2048

Dear Senator,

On behalf of 5,607 members and supporters of the Council of Citizens Against Government Waste (CCAGW) in Oklahoma, I urge you to sustain Governor Stitt’s veto of HB 2048, which will change how the federal 340B Drug Pricing Program operates in Oklahoma. 

 Reforms to 340B should be made by Congress, not in the states.  An April 2025 Senate Committee on Health, Education, Labor, and Pensions Majority Staff Report reiterated the federal government’s  jurisdiction over 340B and cited five reforms that can only be enacted by Congress, including greater accountability and transparency on how savings are directed to patients and a clearer definition of eligible patients.  And Sen. Markwayne Mullin (R-Okla.) is a member of the 340B Bipartisan Working Group, which he said would “restore integrity and intent to the 340B program.” 

In 2023, forgone rebates on prescriptions filled with 340B pricing increased Oklahoma commercial employer costs by $73.9 million and state and local government healthcare plans by $13.6 million.  340B contract pharmacy mandate bills like HB 2048 would increase costs by $12.1 million for commercial employers and $2.2 million for state and local government plans.  There is no reason to risk Oklahoma taxpayers’ money by enacting HB 2048.

I again ask you to vote against any attempt to override Gov. Stitt’s veto of HB 2048.  Rather than acting on legislation that impacts a federal program, I urge you to contact Oklahoma’s congressional delegation and support their efforts to reform 340B.
